Terms and Conditions

To subscribe to and use BEST in CARE, you must agree to the following terms and conditions in full. To accept or decline this agreement, click on the corresponding link at the end of this document.

Users of the BEST in CARE Website and its Member Areas ("BEST in CARE") acknowledge that they are at all times subject to and bound by these terms and conditions. Any User who is not prepared to be subject to these terms and conditions should immediately log off from this Web Site.

  1. BEST in CARE reserves the right to deny or cancel access to BEST in CARE’s services at any time or from time to time at its sole discretion and for any reason.
  2. BEST in CARE’s goal is to provide an information service to users on a number of subjects relevant to elder care. Neither BEST in CARE nor its related or affiliated companies or persons accept any liability or responsibility to Users for the content of the information provided by BEST in CARE, nor can BEST in CARE be responsible in any way for the accuracy or completeness of any information which a User received from BEST in CARE. Further, no representation or warranty is made, either express or implied, with respect to the accuracy or completeness of any information provided by BEST in CARE.
  3. BEST in CARE disclaims any liability or responsibility for any loss, damage, cost or expense, or any injury suffered by any User or any other person which results directly or indirectly from the use of any information, product or service listed, shown or received by accessing BEST in CARE, including without limitation, direct, indirect, special or consequential damages, however caused. In no event shall BEST in CARE’s liability to any User exceed the amount of any fee or consideration paid by such User to BEST in CARE.
  4. BEST in CARE does not endorse or recommend any product, service or facility. The inclusion of any information, service, product or facility shown or listed by BEST in CARE does not represent or imply, directly or indirectly, any endorsement by BEST in CARE. Accordingly, any User who purchases or uses any such service, product or facility, does so at his or her own risk and is solely responsible for the consequences of such purchase or use, including having made their own assessment as to what usage they shall choose to make of any information herein provided.
  5. The placement of an advertisement on this Web Site does not constitute the endorsement of BEST in CARE or its services by the advertiser. No advertiser on this Web Site is responsible in any manner for any information provided to Users by BEST in CARE. Any advertisement on this Web Site is independent of BEST in CARE and is not an implied warranty of accuracy of any advertiser's material or content. The User is to make his/her own evaluation of any material contained in any advertisement and shall not look to or rely upon BEST in CARE for the accuracy of same.
  6. The inclusion of any advertisement on this Web Site does not constitute an endorsement by BEST in CARE of the product or service being advertised and BEST in CARE assumes no responsibility or liability to anyone who purchases any product or service advertised on this Web Site.
  7. The User acknowledges that BEST in CARE does not and cannot provide any warranty or assurance with respect to the adequacy of any product, service or facility for a User's particular needs nor can BEST in CARE be responsible if any product, service or facility listed is not available to a User, or does not meet the needs of any User.
  8. BEST in CARE provides an information service only. BEST in CARE is not a replacement or substitute for medical, psychological or other professional counseling or treatment. Users should supplement the use of BEST in CARE with their own research and investigations and the advice of their medical and/or other professional advisors.
  9. The information provided by BEST in CARE is for the use of its Users and cannot be reproduced by Users except in the manner outlined in point 10 of this document. Any unauthorized reproduction or sale of information provided by BEST in CARE is prohibited and constitutes a breach of applicable law, including copyright and other intellectual property rights.
  10. Professional subscribers may reproduce materials on the BEST in CARE Website for their own use. They may also print and distribute information and materials found on the BEST in CARE Website for their clients, provided that such materials are properly and clearly credited to BEST in CARE. However, under no circumstances can they sell information and materials found on BEST in CARE. General subscribers may ONLY print and reproduce materials for their own personal use. They cannot sell information and materials found on BEST in CARE.
  11. BEST in CARE has the sole, exclusive and only right to reproduce, reuse, repackage and sell the information which it provides. All the information provided by BEST in CARE is either reproduced with permission or is the copyrighted and proprietary property of BEST in CARE.
  12. All fees payable to BEST in CARE must be paid in advance by cheque or credit card.
  13. BEST in CARE reserves the right to deny access to its information and services to any User who fails to abide by these terms and conditions.
  14. Where required by applicable law, Users must be at least 18 years old or the minimum age required by law.
  15. Access to BEST in CARE and the use of its information services is governed by the laws of the Province of Ontario, Canada and the laws of any other jurisdiction or place are specifically excluded.
  16. BEST in CARE is located at 15 Wertheim Court, Suite 202 Richmond Hill, Ontario L4B 3H7. BEST in CARE’s officers, directors, agents, employees and shareholders are and shall be entitled to the protection of these terms and conditions and shall be subject to them.
  17. These terms and conditions can be changed or modified by BEST in CARE at any time or from time to time. Any such change or modification shall be effective immediately.
